時間をかければかけるほど正義に近づくためのものではないはずです。
けれど現実には、
再審開始の判断が下された後も、
検察側の抗告によって手続きが長期化し、
その間、当事者は長い時間を待たされることになります。
もし異議があるのであれば、
それは本来、裁判の場で尽くされるべきものではないでしょうか。
時間をかけて検証することと、
時間を費やし続けることは、同じではありません。
時間は取り戻すことができない以上、
その重みを前提とした制度であるべきだと感じます。
A retrial system should not exist
simply to move closer to justice
by taking more and more time.
And yet, in reality,
even after a retrial is approved,
prosecutors’ appeals can prolong the process,
forcing those involved to wait for years.
If there are objections,
should they not be fully addressed
within the courtroom itself?
There is a clear difference
between taking time to examine a case
and allowing time to be consumed indefinitely.
Time cannot be restored.
And any system that deals with justice
should be built upon that reality.
