Terms and Conditions for Photography Services 2026 - Events
These terms and conditions outline the policies and practices of Miceshooter
("Photographer") regarding the provision of photography services in the Netherlandsand Europe.
By engaging the Photographer, clients acknowledge and agree to these terms and
conditions
-Photography services are provided in accordance with these terms. Any changes to these terms will be communicated and mutually agreed upon via email
-The photographer operates independently. Third parties may not impose agency fees unless discussed and agreed upon with the photographer in advance
-The photographer will not be subject to non-compete clauses in any form
-The photographers goes to the event around 30minutes before the first act ends, and leaves after making shots from the last act. Those are times where there's not much to photograph
Booking, Payment and Cancellation
-A booking is confirmed upon agreement of terms avia email/whatsapp/call
-The balance is to be paid within 30 days of the date of the event in compliance with dutch law. Late fees of 2% per day shall be applied to overdue invoices
-In case of rescheduling, the Photographer will make reasonable efforts to accomodate a new date, subject to availability, without additional charges if the request is made more than 4 weeks before the original session date
-7 days or less before the scheduled session will be charge 100% of the agreed fee
-2 weeks or less before the scheduled sessions will be chargedd 75% of thge agreed fee
-4 weeks or less before the schedduled session will be charged 50% of the agreed fee
-Cancellations made more tthan 4 weeks before the scheduled session will not incur charges
Copyright and Image Usage
-All images produced by the photographer remain the photographer's intellectual property
-Clients are granted the Basic license which includes the usage of the images for Social Network and website during 2 years
-Images may not be altered, cropped or edited without permission from the photographer, even from third parties
-Images may not be shared unedited. Non-compliance or unwilingness to alter credits, will result in a 500⎠penalty
-All images are exclusively licensed to the specific client that hired me for the specific project according Licensing Terms. Any redistribuition or use by third parties requires separate written permission from the photographer and will incur in additional licensing fees
The client is granted a license to use the delivered images under the following conditions:
-Usage: Social Media + Website
-Territory: Netherlands only
-Media: Instagram, Facebook, TikTok, Website
-Exclusivity: Non-exclusive (Photographer may reuse the image unless otherwise agreed)
-Modifications: Basic cropping/filters not allowed, no retouching or commercial editing without written permission
-Credit: Required when posting online: ÂĐ Miceshooter / @miceshooter, or just Gonçalo Rato in case not possible to tag
-Commercial Use: Not permitted unless extended license is agreed and paid for in writing
All image rights remain with the photographer (copyright holder), except when a separate agreement is made for full buyout or exclusivity.

Photographer's Use of Images
-The photographer reserves the right to use the images for portfolio purposes, promotional content, competitions and exhibitions. The client will never put any restriction to the photographers when posting on social network
-If opting out the image use, the client may be subject to an additional fee for exclusive rights, which will be discussed and agreed upon prior to the session
-Clients are responsible for providing accurate session details, including location and special requirements. Also to provide all permissions/guest list/ID to access the venue
-All the requests about photography services will be done before the event in a written way, requests during the event may not be answered
-Necessary permissions, such as property releases or permits, must be secured by the client, but also payment for locations, productions costs, on set catering, travel costs and lodging
-The photographer is not responsile for issues arising from a lack of required permissions
-The client is responsible for providing quitclaims if applicable
-Inform the photographer the presence of lasers, or harsh situations as euphoric crows, dirty places, and others. If results in any damage regarding any of this situations and the photographer was not informed client responsabiolizes for damaged equipment
-The photographer reserves the right to terminate coverage and leave the location of the event if experiencs innapropriate, threatening, hostile or offensive behaviour from person(s) at the event
-Edited Images will be delivered via an agreed upon timeline. Typically event timelines are 3 to 5 working days (not weekends).
-A fast turnover can be providade for an additional 100âŽ/day/event (with this fee the pictures are delivered until a maximum of 3 days)
-Images will be delivered via an online link that will be online for 7 days. After this, it is the responsaility of the client to safekeep all images
-While every effort is made to deliver high-quality images, the Photographer is not liable for circunstances beyond his control, such as equipment failure or unforeseen events
The photographer is not liable for disruptions due to weather conditions, acts of god, or other force majeure events. The photographer is to be paid in line with their cancellation policy
-In cases where services cannot be delivered, the photographer's liability is limited to the amount paid by the client. Returning part of the fee, as the other part is to cover work time
-3 months after the delivery of the images, the photographer retains the right to delete original files. It is the responsability of the client to safekeep all delivered images and the photographer is not liable for any lost data past 3 months
Privacy and Data Protection
-Personal data is handled in compliance with the general data protection regulation (GDPR)
-Client information is not sharedd with third parties without consent, excpet as required by law
-These terms are governed by the laws of Netherlands. Any disputes will be resolved in Dutch courts
Social Media and Image Credit
-Clients are required to tag @miceshooter or Gonçalo Rato/Miceshooter in any social media posts that feature images taken by the photographer
-All images produced by the photographer are licensed under copyright. If an image is to e usedd for any commercial purposes or without the appropriate creadit, a buyout of the image must be made. The buyout fee will be determined based on the intended use of the image
-The buyout feed will be determined based on the scope, duration, and intended commecial use of the image. Fees start at 150⎠and vary according to publication and presses
-By booking photography services with Gonçalo Rato/Miceshooter, clients confirm that they have read, understood and agree to these terms and conditions in full
