Author Terms & Conditions

Towards Data Science is a publication of Insight Media Group, LLC (“TDS”, “we”, “us” or “our”). While our website (https://towardsdatascience.com) (the “TDS Publication”). 

THESE TERMS HAVE PROVISIONS WHICH LIMIT OUR LIABILITY AND IMPOSE OBLIGATIONS ON YOU.  

About TDS

TDS curates data science content from authors. We have a team of editors who determine what authors to include in the TDS Publication. While TDS editors may request amendments to an author’s work, we do not peer review or make substantive edits. We also publish videos and podcasts.

Becoming an Author and Content Submission Rules

To submit an article for us to consider for publication (a “work” or “content”) please visit, Write for Towards Data Science”. If we decide to publish any of your works as part of the TDS Publication, you agree that you shall comply with both the Submission Rules and the Guidelines which are incorporated by reference in these Terms. 

  • Please don’t submit more than three stories at once.To ensure a timely response to all authors, we ask that you only send us up to three stories at a time, and wait until you hear back from us before you send the next one. If you’ve written a longer series, you can send it all in one go, but please leave a note in your first post to let our team know.
  • You can make minor edits to a published articleas long as they respect our rules and guidelines.
  • Any article you share with us must be entirely your own original work; you can’t take other writers’ words and present them as your own.
  • We might directly edit your content to correct basic spelling mistakes and update minimal formatting. Also, we might remove images where the source isn’t clearly stated. 
  • We can remove any articles you post on TDS for any reason. 
  • If our editorial team finds one or more violations of our rules, we can remove you and all of your articles from our publication.

Application of these Terms

You agree that these Terms, and any representations or warranties you make herein, apply to all of your works, regardless of when they were included on the TDS Publication or other platforms you permitted us to use them on, such as our YouTube channel.  If you believe that any of your existing works may not comply with these Terms, or our Submission Rules and Guidelines, please inform us immediately at [email protected].

Acceptable Content 

You agree that none of the works (whether written, audio or visual) you upload or provide to us will include any content that:

  • is not your own work, or that has been otherwise copied, borrowed, or plagiarized;
  • violates another person’s or entity’s rights, including their copyright, trade secret, publicity, or other intellectual property rights; 
  • constitutes or encourages a criminal offense, gives rise to civil liability or violates any laws, rules or regulations, including but not limited to fraud, piracy, or hacking;
  • is unlawful, obscene, defamatory, libelous, harmful, hateful, harassing, racially or ethnically offensive or abusive; 
  • constitutes legal, tax, medical, health, investing or financial advice; 
  • content that is promotional in nature;
  • content that promotes illegal activities; or
  • discloses personally identifiable information belonging or pertaining to others, unless you have their authorization to do so.

Privacy

When you submit your works to us to include in the TDS Publication, you may only do so under your real name. We do not permit the publication of content from anonymous authors or the use of pseudonyms. 

When you submit works to us, or otherwise interact with us or the TDS Publication, we will collect certain personal information from you, in accordance with our Privacy Policy, which is incorporated by reference. Copyright Ownership

You own the rights to the content you create and post on our TDS Publication. We claim no copyright ownership in your works, whether you publish text, images, audio or videos. However, you represent and warrant to us that (i) all of your works are original works; (iii) that you are the original author of the written works you submit to us; and (ii) to the extent you provide us with, upload or embed images, audio or videos in your works, you either own or have acquired a license or other right to publish, and to license to us the right to publish, such images, audio and videos along with your work.

License to Your Works

When you submit works to us to publish, you grant to us a non-exclusive, royalty free (unless otherwise agreed by us), fully paid up, sublicensable, transferrable, worldwide right and license to copy, modify, distribute, publish, display, transmit, translate, create derivatives of and otherwise use the works for the purpose of publishing such works as part of the TDS Publication, and where applicable, our YouTube channel. If you submitted works to us prior to the effective date of these Terms, your submission is subject to the license terms in effect at the time of your submission.

In connection with the publication of your works, you agree that we may also upload your works to various third-party services that perform (i) plagiarism detection;[1] (ii) automated grammar and spelling checks;[2] and (ii) artificial intelligence3 (“AI”) detection (intended to detect if AI or machine learning software was used to create any part of your works), or other, similar services.

You grant us all necessary rights and licenses to your works in order to permit us to upload your works to such third-party services for the purposes set out above. In doing so, you agree and acknowledge that your works may be used by such third parties for various purposes, including the purpose of training AI models with your works.

Where you provide us with video or audio content, you agree that we shall be permitted to publish such works via YouTube and other online video platforms which we may use for various purposes, including embedding such video and audio content on the TDS Publication. 

Copyright Infringement; Digital Millennium Copyright Act

We take copyright infringement seriously. If you believe that your copyrighted works are available on the TDS Publication without your consent, please email us at [email protected]. Where we reasonably suspect works have been published against the rights of a copyright owner, we will remove them from the TDS

Publication. 

You are Responsible for Your Works

You agree that you are responsible for the content you submit to us, regardless of whether we publish your content. You assume all risks related to the content and information you provide us and contribute to the TDS Publication, including, for example, someone else’s reliance on its accuracy, or claims relating to intellectual property or other legal rights. 

Modifications and Disclaimers

While we do not peer review or make substantive edits, you agree that we may (i) make grammatical modifications to your works and add images to them; (ii) remove images which do not comply with our these terms or which we have reason to believe may not be duly licensed or attributed; and (iii) request amendments to your works, both prior to and after they are published.

We may also add disclaimers to your works (including written works, videos and audio content). 

Fees 

We do not charge authors to publish their works as part of the TDS Publication.  

You agree that granting you the exposure to your works via the TDS Publication constitutes good and valuable consideration in exchange for agreement to these Terms. 

As the TDS Publication merely curates data science content from authors and your relationship with us is only that of an independent contracting party. Unless agreed to separately in writing, you are not an employee of ours, nor are you an agent, joint venturer or partner of ours. You agree that to the fullest extent permitted by law, no partnership relationship shall exist or be deemed to exist between you and us. 

Indemnification

You agree to indemnify us, our affiliates, employees, editors, shareholders, directors, agents, representatives and contractors, and to defend and hold each of them harmless, from any and all claims and liabilities (including reasonable legal fees) which may arise from; (i) your violation of these Terms, or any policy incorporated by reference; (ii) your violation of any third party right, including their intellectual property rights; (iii) any breach of a representation or warranty made by you to us, either in these Terms, our Privacy Policy or otherwise; or (iv) any claim in which a third party alleges to have suffered damages as a result of your content (or any reliance thereon), for any reason.

Limitation of Liability

YOU AGREE THAT TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, EDITORS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU,

FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES YOU SUFFER, HOWSOEVER CAUSED, INCLUDING BY NEGLIGENCE OR OTHERWISE, REGARDLESS OF LEGAL THEORY AND WHETHER OR NOT WE HAVE BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER THOSE DAMAGES WERE FORESEEABLE OR NOT.

You agree that any provisions in these Terms which obligate you to limit the liability of, hold harmless, waive rights in favor of, or indemnify any person or entity who is not a party to this agreement (such as our directors, officers, shareholders, employees, contractors, editors and others), that such obligations are accepted by TDS as agent and trustee for each such third-party. TDS declares itself trustee of such covenants and obligations for each such third party; such covenants and obligations may be enforced by TDS on behalf of any such third-party.

Choice of Law and Jurisdiction

These Terms, all documents incorporated by reference and your relationship with us, shall be governed by, construed and enforced in accordance with the laws of the state of New York, as it is applied to agreements entered into and to be performed entirely within such province. 

If any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate shall be determined in arbitration by a single arbitrator, pursuant to JAMS’ Streamlined Arbitration Rules and Procedures. The arbitration shall be held in New York, New York, or at the election of the arbitrator, remotely by exchange iof briefs or by video conference. Judgement upon the award rendered by the arbitrator may be entered in any court having jurisdiction. There shall be no appeal from the decision of the arbitrator whether on questions of fact, law or mixed fact and law. 

Severability 

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

No Interpretation Against Drafter

If an ambiguity or question of intent arises with respect to any provision of these Terms, the Terms shall be construed as if drafted jointly by the parties and no presumption or burden of proof will arise favoring or disfavoring either party by virtue of authorship.

Waiver of Class Proceedings 

To the fullest extent permitted by law, you waive your right to participate in any class action lawsuits against us, our contractors, employees, shareholders, successors, assigns, editors, officers and directors. 

Assignment of this Agreement

You agree that we may assign this agreement to any successor or assignee, whether pursuant to the purchase of the TDS Publication, or by merger, acquisition or other transfer of control or otherwise. 

Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. 

Updates to these Terms

As the TDS Publication and our business may change, we may update these Terms, our policies and our Submission Rules and Guidelines, from time to time. The date of the last version of these Terms is posted above. You will be able to find the most recent version on our website at https://towardsdatascience.com/. As you are bound by these Terms each time you submit new works, you should review the latest version of these Terms each time you make a submission. We may also inform you of the changes via email.
