I Actually Stood in Court for the Eviction Lawsuit - 2nd. Edition

Introduction

In January 2025, I posted an article titled "I Actually Stood in Court for the Eviction Lawsuit," summarizing the circumstances leading up to the lawsuit and the progress of the trial up until the scheduled judgment date the following month.

Subsequently, a judgment was rendered, and the plaintiff’s claims were accepted, except for the provisional execution declaration.

As a result, I filed an appeal, and the first oral argument for the appeal is scheduled to be held at the Tokyo High Court on Wednesday, June 18, 2025.

In this article, I will provide a more detailed account of the events described in the previous article and include updates on what happened afterward.

This eviction lawsuit is closely related to the incidents that I have been reporting as "unimaginable human rights violations."


Timeline of Eviction Negotiations

2022

February:

Event: SMC acquired land for constructing a new technology center (excluding the land where the current building is located; acquisition completed by February 2023).

Note: SMC is a Tokyo Stock Exchange Prime Market listed company that holds the global top position in pneumatic control equipment for factory automation (Source: Kaisha Shikiho Online).

April 4 (Monday):

Event: Launched a Twitter (now X) account. Initially named "人で無き子" (Hito-de-Naki-Ko).

In February 2024, the account name was changed to "えむたや1st," used primarily for everyday content, while posts related to human rights violations were moved to a separate account, "えむたや."

May:
Event:
Commenced boring surveys at the aforementioned site.

2023

February 12 (Sunday)
Event:
Notices from Daito Trust Construction Partners stating that the management company would change at the end of February were distributed to mailboxes of all units.

Same Day
Event: Sent an email to Daito Trust Construction Partners via their website.

Email Content: "Incident X remains unresolved, and it is related to human rights violations that should be condemned globally."

What is "Incident X"?
"Incident X" refers to an incident in May and August 2021, during which an employee of SMC and an official from Kashiwa Public Health Center visited my residence. Despite the fact that the woman who accompanied them was clearly a different person, they insisted that she was the same individual as before.

February 20 (Monday) - 23 (Thursday)

Event: Sent certified mail to over ten institutions and companies, including the National Police Agency, Daito Trust Construction Partners, TV Tokyo, Sotetsu Hotel Management, and Lawson (Chain Convenience Store).

Content: A protest against the lack of response to the issues I had been reporting and inquiries regarding unusual incidents at these institutions.

Note: Nippon TV refused to accept the mail.

February 28 (Tuesday)
Event:
Two representatives from the new management company visited my residence to provide an introduction and explain rent payment procedures.

March 18 (Saturday)
Event:
Four individuals visited my residence—two from SMC and two from the negotiation agency My Life Housing Co., Ltd.
Eviction negotiations commenced.

Reason for Eviction: Building deterioration due to age (14 years old; however, the legal service life is 47 years).

Response: Sent an email to the above four individuals explaining why I could not agree to the eviction.
I also requested them to refer to the relevant posts regarding the series of unusual incidents (46 posts noted in the preparatory brief (1)).

Note: Although a new lease agreement was presented, it may potentially violate Article 30 of the Land and House Lease Law.
The plaintiff did not submit it during the filing of the lawsuit or during the trial.
I confirmed the contract after the renewal date but subsequently lost it.

April 14 (Friday)
Event:
Sent an email to My Life Housing Co., Ltd., suggesting that the plaintiff inquire with Daito Trust Construction Partners and TV Tokyo regarding the matter.

August 31 (Sunday)
Event:
The lease agreement renewal date. Subsequently, the lease became an indefinite-term contract (Article 26, Paragraph 1 of the Land and House Lease Law).

December
Event:
Full-scale construction of the new technology center commenced.

2024

January 25 (Thursday)
Location:
The entrance of the subject building

Event: Received a "Termination Request Notice" from SMC, delivered by My Life Housing Co., Ltd.

February 19 (Monday)
Event:
Sent certified mail to 15 institutions and companies, including the National Police Agency, Daito Trust Construction Partners, TV Tokyo, Sotetsu Hotel Management, and Lawson.

Content: A summary of unusual incidents experienced at these institutions, sent with identical content to all recipients.

Note: The National Police Agency refused to accept the mail.

March 15 (Friday)
Event:
Sent a web letter to the SMC General Affairs Manager, attaching the full content of the certified mail sent on February 19.

April 2 (Tuesday)
Event:
During a morning meeting, the SMC General Affairs Manager stated that the above web letter was not received.

Immediately after the meeting, I sent the full content of the letter to My Life Housing Co., Ltd.

July 11 (Thursday)
Event:
Received a certified mail from the new General Affairs Manager of SMC, containing a warning of potential litigation.

July 15 (Monday)
Event:
Sent a certified mail to the new General Affairs Manager of SMC, attaching the full content of the letter that was allegedly undelivered to the former General Affairs Manager.

July 26 (Friday)
Event:
Inquired at the post office regarding the non-delivery of the above web letter.

August 10 (Saturday)
Event:
Received a certified mail from the General Affairs Manager of SMC, suggesting the possibility of a damage claim.

Event:
Received the complaint via special delivery from the Tokyo District Court Civil Division.

Commentary

This case is not just an ordinary eviction lawsuit for me. It is deeply connected to what I have been reporting as "unimaginable human rights violations."

My residence has been the site of alleged torture and human experimentation and is a crucial location for verifying the existence of Anomalous Health Incidents (AHI). The torture I experienced includes acts that could be considered attempted murder.

Furthermore, if I were to relocate to another place, similar incidents might occur, potentially involving nearby residents and real estate companies.

For these reasons, I have consistently refused to comply with the eviction request. Despite having suggested measures to resolve the issues to the plaintiff, my proposals have been entirely ignored.

There were also suspicious incidents both in the courtroom at the Tokyo District Court and in the record viewing room at the Tokyo High Court.

Some of these episodes may cast the courts in a negative light and could potentially affect the outcome of the appeal trial. Nonetheless, I plan to document them as part of the record.
