スターマー首相の労働党政権で言論・表現の自由が大変なことになっている！学校では外国旗はOK、ユニオン・フラッグの英国人生徒は教室から排除の理不尽 '26.5地方選で与党大敗、6.22スターマー辞意表明、7.20バーナム首相誕生 DEIで抜擢ケンブリッジ大教授の盗用剽窃・経歴詐称を取材で警察が圧力
労働党のスターマー首相によって、外国人 / 移民の凶悪犯罪者が野放し状態にされ、国民から怒りの声が絶えない英国。一方、1日３０人、年間1万人以上もの英国民が言論・表現をめぐって警察のやっかいに。
弁護士・検察出身のキア・スターマーが率いる労働党が政権をとってから、イギリスの言論や表現が危機的状況に陥っています。不法入国した難民申請者が英国民の税金でホテル滞在しなが地元の少女を毒牙にかけ、移民の男が女性を暴行して言い渡された罰が、刑務所行きではなく社会奉仕活動で済まされる始末。厳しい経済状況、搾り取られる税金、外国人や移民による犯罪の増加で生活環境が悪化する中、イギリス人は自由にものを言う（書く）ことまで制限されるようになりました。
新聞等で取り上げれられた事例を紹介します。
◆ 学校のWOKEイベントでユニオン・フラッグを身に着けた生徒を排除
２０２５年７月、学校の多様性を祝う文化イベントで、ユニオン・ジャック柄の服（1997年に人気女性歌手グループのスパイス・ガールズが着用していた衣装に似たデザイン）を着ていた１２才の女子生徒が、スピーチをすることを許されずイベントから排除されました。学校は後に謝罪しましたが、非常に後味の悪い出来事です。また同じ文化イベントの日に別の学校では、１５歳の女子生徒がユニオン・フラッグを纏っていたところ、３０人ほどの生徒がいた教室から退室させられました。外国にルーツがある生徒らは外国の国旗を身に着けていたにもかかわらず、ユニオン・ジャックだけが禁じられた形です。
◆ 政治家への不満・批判をFacebookに投稿したら警官が自宅訪問＆電話
Facebook（クローズのものとオープンのもの）で労働党の地方議員について「辞めるべき」と書き込んだ中年女性の自宅に、２０２５年初め、刑事と警官の２人が訪問（訪問時は外出中。防犯カメラ映像が記録）。その後警察から電話があり「貴女の投稿について警察に苦情が来ている」と告げられました。女性が「書き込みが犯罪ですか？」と尋ねると、「犯罪ではありませんが、忠告まで」と返答。何ら問題のない議員批判の投稿に警察から「忠告」を受け、投稿女性だけでなく、英国社会に衝撃が走りました。
◆ 保護者グループのWatsAppで小学校への不満・文句を書いただけで逮捕２０２４年５月、長女が通う小学校の教員の選考過程についての不満・苦情をメッセージアプリWatsAppに書き込んだところ、学校側から警察に通報があり、２０２５年１月に夫妻を逮捕、８時間ほど独居房に留置。夫妻を逮捕後、６人もの制服警官が家宅捜索を実施。後に警察は逮捕の要件を法的に満たしていなかったことを認め、夫婦それぞれに10,000ポンドずつ支払うことになりました。
◆ 店内の万引き防止貼り紙に警官が言いがかり
２０２５年８月、ヴィンテージショップの店内に掲示された「万引きするクズ野郎 scumbag（スラング） がいるので、棚を開けてほしい時には声をかけてください」との貼り紙について、店のオーナーに話があると警官が訪問。「不快で攻撃的な印象を与えるので、外してください」と詰りました。店主が「万引きの損失は大きく、未然に防ぐためのもの」と伝えると、「万引き事件が起きた時に、警察に連絡を」と返されました。店主は、以前に万引き犯を取押え警察に通報したことがありますが、警察は万引き犯が盗んだ商品を返還させただけで、犯人をそのまま家に帰しました。万引き犯にお咎めなしの一方、掲示にイチャモンをつける警察の対応に納得できず、店には注意書きがそのまま掲示されています。「万引き犯にとっては不快かもしれないが、違法性も反社会性もない文言」、と「窃盗事件」より「警告文」を問題視する警察にショップオーナーは憤りを隠せません。
◆ 女性専用スペースの自称女の使用制限をXで訴え、武装警官５人に逮捕
２０２５年９月、アイルランド人人気コメディ脚本家のグラハム・リネハン氏が、アメリカからイギリスに入国した際、武装警官が５人がかりで同氏を逮捕という驚くべきニュースが英語圏の国で話題になりました。リネハン氏はX（twitter）に、「女性専用スペースにTG（女のふりした男）がいたら警察に通報！間に合わなかったら、🟡🟡をパンチ(スラング)」と投稿していまいた。リネハン氏の逮捕について、『ハリーポッター』の著者J・K・ロリーング女史が「全体主義」と批判。イーロン・マスク氏も「警察国家」と反応し、アメリカでも「脅かされる英国の言論」として主要メディアで大きく取り上げられました。
英国在住のリネハン氏は近年、行き過ぎたトランスジェンダー政策を度々批判し、トランスジェンダー活動家ソフィア・ブルックスと名乗る１７歳自称女性の男性と度々ネット上で口論していました（リネハン氏はブルックス氏をソシオパス、テロリストなどと中傷。ブルックス氏はリネハン氏の住所や家族の個人情報を拡散）。ところが去年の１０月にロンドンで開催されたイベントの会場で、ブルックス氏と出くわし喧嘩になり、同氏のスマートフォンを投げつける事件に発展。リネハン氏はブルックス氏に対するハラスメントと器物損壊で訴追されていました。ロンドン警視庁はTG活動家とのトラブルの経緯を勘案してXの投稿を問題視したと思われますが、Online Safety Act 2023 の悪用、恣意的適用との批判があります。警察は政府による明確な基準が規定されておらず、現場が動きづらいと弁明していました。それにしても、５人の武装警官は行き過ぎです。リネハン氏は逮捕直後、血圧が急上昇し、病院に搬送されたといいます。
５０代のオッサンが１７歳の活動家とバトルとは、大人げない印象を持つ読者もいるかもしれません。しかしLGBTQ政策で日本より先をいく北米や英国では、とんでもない事態が発生しているのです。アメリカのバージニア州では性自認を女性とする男子生徒が、高校の女性トイレで女子生徒を暴行。学校は事件を隠蔽し男子生徒を転校させましたが、転校した学校での再犯が発覚。イギリスでは複数の女性を暴行し逮捕された男が、起訴後、女子刑務所に収監されるべく女性を自称するといった問題が発生しました（被害者らの猛抗議で男子刑務所に収監）。
リネハン氏には年齢性別はわかりませんが２人の子供がおり、このような米英の状況を危惧していたのでしょう。因みに活動家とのトラブルをめぐる刑事裁判では２０２５年１１月、ハラスメントについては無罪、スマートフォンを投げつけ故障させたことには罰金が科され、有罪となりました（罰金と弁償）。訴訟において被告側弁護士は原告の活動家を男性名詞で呼称、検察官は女性名詞を使用。裁判官は「個人の性別や性自認について判断する場ではない」として、告訴人やgender neutral pronouns(男性・女性を特定しない呼称)を使っていたそうです。
◆ サウスポートダンス教室女児殺傷事件に端を発したネット投稿で逮捕者
最後に、英国各地で反移民の暴動のきっかけとなったサウスポート殺傷事件に関するネットへの投稿で逮捕された被告の事例を紹介します。２０２４年７月、ダンス教室で幼い少女達がアフリカ系の１７歳の男に刺殺された事件について、インターネット上で移民政策に対する不満が大量に書き込まれました。アフリカのルワンダから移住してきた両親のもとに英国で生まれた犯人について、「移民１世」、「イスラム教徒」などの書き込みが広まったことで、「誤情報 / 偽情報を拡散」、「暴力行為を扇動」したとして、投稿者らが逮捕されました。誤情報については、無差別殺人の犯人は事件発生後時間をおかず逮捕されていたにもかかわらず、出自・属性についての公表を渋っていた警察あるいはメディアの姿勢にも問題があります。また捜査当局はテロとは無関係と発表していましたが、後に犯人は毒物リシンを生成したり、アルカイダの訓練マニュアル所持していたことが判っています。
そういった事情からなのか、誤情報を投稿して逮捕された人については警察は立件を見送っています。しかし、暴動を煽ったり、暴動の様子を投稿し称賛するかのような言動をした人物らには、人種憎悪や暴力扇動、騒乱の罪で重い罰が下されています。実刑を言い渡された被告の中には、保守党の地方議員の妻 (Lucy Connoly ＝ 51) が含まれています（Public Order Act 1986 違反）。彼女は「不法移民は全員強制送還、移民収容ホテルに火を放とう」と投稿していました。書き込みについては反省していますが、懲役２年７か月の判決を不服とし控訴しています。コノリー被告については、刑が重すぎるとして国内外で問題視されています。フランスを経由して舟で渡ってイギリスに入国してくる不法移民の多くが男性であることから、治安上の懸念から発したツイートだと同情の声も多数あります。
量刑や犯罪（書き込み内容）の態様がコノリー被告（保守党地方議員の妻）の事例と頻繁に比較される、懲役１８か月の判決を言い渡された３６歳の男（Luke Yarwood）の事案も紹介しておきます。
ヤーウッド被告は２０２４年１２月、ドイツのクリスマスマーケットに車が突っ込んだ事件に反応して、「我々イギリス人は皆で不法移民のいるホテルに火を付けに行こう。その後、国会議員らの家に向かって、最後は国会だ！」、「この街に長年暮らしながら、移民は全く英語を話さない」などとX (twitter) 書き込んで逮捕。刑事裁判で懲役１８か月の罪を言い渡されました。折り合いが悪かった義理の兄弟に通報された被告の書き込みは、閲覧数が３０回程度。有名インフでもなく、「放火しよう」など本気で思っているわけではありません。バージニア州・シャーロッツビルで松明を持って行進したオルトライトに参加するような行動すらなさそうな人物です。弁護士は、騒乱目的の書き込みではなく、扇動には当たらないと主張していました。移民の凶悪犯罪に対する刑罰の軽さ（女性に性的暴行した男が、刑務所送りではなく地域奉仕程度で済まされる）に比して、大衆を扇動して暴動を引き起こす危険性などなかった男に対する重い量刑に批判的な見解が多く見られます。
ネット規制の原因となった２０００年代後半以降の暴動・騒乱と移民犯罪
イギリスでは２０００年代後半、黒人男性を警官が銃撃したたことへの抗議が暴動に発展。さらに公共サービスへの支出削減に抗議する集団が、ロンドンで有名企業の店舗を襲撃する事件が発生したことをうけ、暴動や騒乱の扇動に繋がる言動に厳しく対処してきました。トランプ大統領は、スターマー首相との会談において、アメリカのSNS等の企業が英国や欧州の言論統制によって負担を強いられることの懸念を伝えました。またヴァンス副大統領は、言論・表現の自由は民主主義の根幹であると強く訴えています。影の内閣（トーリー、保守党）の法務大臣からも、現在の法律の運用が不適切なので対応・改善の必要があるとの見解が示されています。
検察トップだった頃、パキスタン移民による白人女児への組織的犯罪（ロザラム事件）を長年放置していたとイーロン・マスク氏に批判されたスターマー首相。スターマー氏は、トランプ大統領が大好きなマクドナルドの批判ビラを配ってマクドナルド英国法人に名誉棄損で訴えられた環境活動家に対する民事訴訟の被告を無償で支援する弁護士だったのですが（英国の民事訴訟で最長を記録）。今や英国内では、「言論ポリス」、「耳の痛い批判を外部委託して監視するスターマー」と呼ばれ、同盟国アメリカから窘められるまでになりました。因みにスターマ―首相が在籍していた法律事務所は、レバノン出身のアマル・クルーニー女史（米俳優ジョージ・クルーニー夫人）が働くDoughty Street Chambersで、人権問題に強いとされる事務所です。
外国人犯罪に甘く市井の英国民の言論に厳しいスターマー首相は、凶悪犯罪の被告人の弁護をしていた経歴もあるらしく（国選弁護士・法律扶助は税金）、有権者の首相に対する怒りは収まる気配がありません。スターマー首相は、前の労働党党首で、２０１９年の総選挙で「サッチャー時代に民営化された事業の再国有化」を公約に掲げ惨敗、責任を取って党首の座を降りたジェレミー・コービン氏をパージしたり、映画監督のケン・ローチ氏を追放したことで党内の左派からの批判も根強くあります。支持率より言論弾圧を優先するスターマー首相の方針が理解できません。
※ マクドナルド名誉棄損裁判 McLibel
１９８０年代に環境保護団体グリーンピースの活動家がロンドンでマクドナルドを批判するビラを配ったとして名誉毀損（libel)で１９９０年にマクドナルドから提訴される。大企業との訴訟に怖気づき活動を断念する者が出る中、失業中の郵便配達員の男性と庭師とパブの仕事を掛け持ちする女性の二人が本人訴訟で闘った（法律扶助の対象外の案件だったが、スターマーをはじめとする弁護士らがプロボノで助言・支援）。最後まで裁判を闘った二人の被告らは、失業中とアルバイトの掛け持ちだったため弁護士費用を用意できず、当初は弁護士なしで訴訟を闘っていた。
被告らのマクドナルドに対する主な批判
- 家畜の飼養のため穀物が大量消費され、中南米の焼き畑農業で環境破壊
- 零細農家を潰し農地を収奪、貧困国での食料不足（飢餓）の原因
- 低コスト経営のため、畜産動物の飼養環境・屠殺方法が劣悪で残酷
- 低賃金・労働組合潰し・労働安全衛生不備など労働搾取
- 付録のオモチャで子供を釣る不適切なマーケティング
- 高脂肪のメニューは心臓疾患等の原因となり不健康
１９９０年にロンドンの裁判所で審理が始まる。会社はグリーンピース以外の、同社に対して批判的な論評・報道をするメディアや団体に対しても訴訟をチラつかせていた。報道の広がりを敬遠するようになったマクドナルドは１９９５年に和解を提示したが被告らが拒否。１９９９年結審、判決。子供へのマーケティング方法や労働条件について被告の主張を認める内容もあったが、同社への批判は名誉棄損にあたると判断。マクドナルドが勝訴し、約4万ポンドの賠償と会社側の弁護士費用が認められた。
名誉棄損裁判は、資力がない訴訟当事者であっても英国の公的な法律扶助の対象とならなかったかった為、被告らはフランス・ストラスブールの欧州人権裁判所 Cour européenne des droits de l'homme / Europeana Court of Human Rights に、「表現の自由」と「公正な裁判を受ける権利」を侵害されたと訴え、２００５年に原告（McLibel事件の被告）の申し立てが認めらた。欧州人権裁判所は、英政府に対して訴訟費用と損害賠償の支払いを命じた。

A non-crime hate incident is recorded where no criminal offence has been committed, but the person reporting it believes it was motivated by hostility.
In his first speech since being appointed shadow home secretary by new Conservative leader Kemi Badenoch, Philp told the National Police Chiefs' Council (NPCC) and Association of Police and Crime Commissioners conference in Westminster a change in guidance was urgently needed. ……
On Tuesday, NPCC chairman Gavin Stephens said non-crime hate incidents needed to be investigated so that "precursors to violence" were not missed.But Philp told police chiefs their officers should "concentrate on investigating and preventing crime".

In an email to Mr Linehan's lawyers, a Metropolitan Police detective said: "I am writing to inform you that following a review of the evidence by the Crown Prosecution Service, it has been determined that no further action will be taken in this matter. "This decision means that no charges will be brought against Graham Linehan in relation to this allegation. "Please note that this decision may be reconsidered if further evidence or information comes to light." Mr Linehan and the Free Speech Union (FSU), an advocacy group, vowed to sue the Metropolitan Police for wrongful arrest and interference with his free speech rights.

Lucy Connolly's 51-word online post in the wake of the Southport killings led her to jail and into the centre of a row over free speech.
For some, the 31-month jail term imposed for inciting race hate was "tyrannical", while one commentator said Connolly was a "hostage of the British state", and another that she was "clearly a political prisoner".

A Conservative councillor's wife who was jailed after an online rant on the day of last year's Southport attacks "never" intended to incite violence, the Court of Appeal has heard. Lucy Connolly, from Northampton, used a social media post on 29 July to call for "mass deportation now" and urged followers to "set fire" to hotels housing asylum seekers. She is appealing against the sentence of two years and seven months she was given after she admitted inciting racial hatred. Supporters staged a demonstration outside the Appeal Court in London.

The US has criticised the UK’s Online Safety Act, which aims to regulate online content and will affect social media companies – most of which are headquartered there. The vice-president, JD Vance, said the UK government was going down a “very dark path” over free speech.
The White House previously said it was “monitoring” Connolly’s case back in May, adding that the US “remains concerned about infringements on freedom of expression”.
