1. Agreement to Terms

Welcome to Skylit Path. These Terms of Service ("Terms") govern your use of our website at skylitpath.com (the "Site") and your purchase of astrological journals and related products ("Products") from Skylit Path Inc. ("Skylit Path," "we," "us," or "our").

By accessing our Site, browsing our Products, or making a purchase, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not use our Site or purchase our Products. These Terms constitute a legally binding agreement between you and Skylit Path Inc.

We reserve the right to update, change, or modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically to stay informed of any updates.

Our online store is hosted on Shopify Inc. By using our Site, you also agree to comply with Shopify's Terms of Service and Acceptable Use Policy.

2. Eligibility

You must be at least 18 years of age to use our Site and purchase our Products. By using our Site or making a purchase, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding contract, and will comply with all applicable laws and regulations. If you are under 18 years of age, you may not use our Site or purchase our Products under any circumstances.

Our Products are available for purchase internationally. However, you are responsible for ensuring that your use of our Site and Products complies with all local laws and regulations in your jurisdiction. We reserve the right to refuse service or restrict access to our Site from certain countries or regions where our services may not be legally permitted or where we choose not to conduct business.

3. Account Creation

You are not required to create an account to purchase our Products. You may check out as a guest by providing only an email address and billing information.

If you choose to create a Shop account with Shopify, you agree to provide accurate, current, and complete information during registration and to maintain and promptly update your account information. You are responsible for keeping your password secure and confidential and for accepting responsibility for all activities that occur under your account. You must notify us immediately at info@skylitpath.com of any unauthorized use of your account.

You are solely responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information. We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.

4. Products and Services

Skylit Path offers personalized astrological birth chart reports and journals, along with related astrological products. Our Products are delivered digitally unless otherwise specified. For personalized Products, you will be required to provide your preferred name for personalization, birth date, birth time (or approximate time if exact time is unknown), and birth city and country.

We use your birth information solely to generate your personalized astrological chart and Product. If you do not know your exact birth time, you may enter an approximate time such as 12:00 PM, but please note that the accuracy of certain astrological details, including your Rising Sign and House placements, may be affected. We are not responsible for inaccuracies in your Product that result from incomplete or incorrect birth information provided by you. All birth information is encrypted and stored securely as described in our Privacy Policy.

We make every effort to ensure that Product descriptions, images, and colors are displayed as accurately as possible, that astrological calculations are performed correctly based on the information you provide, and that generated content is free from technical errors. However, we cannot guarantee that your device will display colors and images exactly as intended, that the astrological interpretations will resonate with your personal experience, or that the content will meet all your expectations or spiritual needs.

Products may have limited availability or may be discontinued at any time. We reserve the right to limit quantities sold per customer or per order and to refuse service or cancel orders at our discretion. We may update, modify, or improve our Products from time to time without prior notice. Updates will apply to future purchases but not to Products already delivered.

5. Orders and Payment

When you place an order, you are making an offer to purchase our Products. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in pricing or product information, suspected fraudulent activity, or inability to verify your billing information.

You will receive an email confirmation once your order is placed. This confirmation is an acknowledgment of your order, not an acceptance. Your order is accepted when we send you a download link or fulfillment confirmation.

All prices are listed in U.S. Dollars (USD) unless otherwise stated. Prices are subject to change at any time without notice. The price charged will be the price displayed at the time you complete your purchase. We are not obligated to honor pricing errors or omissions.

We accept payment through Shopify Payments, which supports major credit cards including Visa, Mastercard, American Express, and Discover, as well as Shop Pay and other payment methods as available in your region. Payment is processed securely through Shopify Payments, and your payment information is encrypted and handled in compliance with PCI-DSS standards. You authorize us to charge your payment method for the total amount of your order, including any applicable taxes.

You agree to provide current, complete, and accurate billing information, including your name on card, billing address, valid payment card number, and card expiration date. You must promptly update your billing information if it changes. You are responsible for any applicable sales tax, VAT, or other taxes based on your billing address or jurisdiction. Taxes will be calculated and added to your order total at checkout where applicable.

We reserve the right to limit or cancel quantities purchased per person, household, or order, to prohibit orders placed by dealers, resellers, or distributors, and to refuse orders that appear to be placed for commercial resale purposes.

If your payment is declined or fails to process, we will notify you via email. Your order will not be fulfilled until valid payment is received, and we may cancel your order if payment cannot be processed within a reasonable timeframe.

Due to the personalized nature of our Products, orders cannot be canceled once processing has begun. Since generation typically begins immediately after order placement, cancellation is generally not possible. If you need to cancel an order, contact us immediately at info@skylitpath.com, but we cannot guarantee cancellation will be possible.

6. Product Delivery

Our Products are delivered digitally via download links. Upon successful payment processing and order confirmation, you will receive an email containing download links for your Product(s). Download links are typically sent within minutes of order completion, but may take up to 24 hours during peak periods. You can also access download links through your order status page.

Download links remain active for one year from the date of purchase. You may download your Product as many times as needed during this one-year period. We recommend downloading and saving your Product immediately to your device for safekeeping.

After one year, your Product and associated data will be permanently deleted from our servers, and download links will no longer be active. If you need access to your Product after this period, you must purchase a new copy at the current price. We do not offer discounted re-purchases or extended access periods.

To access your Product, you will need a valid email address to receive download links, an internet connection to download files, a device capable of viewing PDF files such as a computer, tablet, or smartphone, sufficient storage space on your device, and a PDF reader application such as Adobe Acrobat Reader, Apple Books, or similar software.

If you experience technical difficulties downloading your Product, please check your spam or junk folder for the download email, try using a different browser or device, clear your browser cache and cookies, or disable browser extensions that may interfere with downloads. If problems persist, contact us at info@skylitpath.com for assistance. We will work with you to resolve download issues, which may include resending download links, providing alternative download methods such as email delivery or secure file sharing, or troubleshooting browser or device compatibility issues.

We are not responsible for delivery failures caused by an incorrect email address provided by you, your email provider filtering our messages as spam, technical issues with your device, browser, or internet connection, firewalls or security settings blocking downloads, or your failure to download the Product within the one-year access period.

Products are delivered as PDF files optimized for both digital viewing and printing if desired. Each Product is personalized and generated specifically for you based on the birth information you provide.

7. Refunds and Cancellations

Due to the personalized, digital nature of our Products, all sales are final and non-refundable. Once your Product has been generated and delivered, we cannot offer refunds, exchanges, or credits. By purchasing from Skylit Path, you acknowledge and agree that digital products cannot be returned once delivered, that your Product is custom-generated based on information you provide, that you have reviewed our Product descriptions and samples before purchasing, and that you understand the nature of astrological interpretations and that results may vary based on personal perspective.

We may offer a full or partial refund in the following limited circumstances. First, if our server experiences an extended outage that prevents journal generation and we cannot fulfill your order within a reasonable timeframe, typically 48 to 72 hours, we will attempt to notify you of the delay and offer you the option of a full refund. Second, if your generated Product contains significant defects such as blank pages, missing sections, corrupted files that cannot be opened, major formatting errors that make the Product unusable, or incorrect birth chart calculations due to system errors rather than user input errors, we may offer a refund after attempting to correct the issue.

You must notify us of any defects within seven days of receiving your Product and provide evidence of the defect such as screenshots. We will first attempt to correct the issue and deliver a corrected Product. Refunds will only be issued if we cannot resolve the defect. Minor variations in formatting, color display, or stylistic preferences do not constitute defects. Third, if you were accidentally charged multiple times for the same order, we will refund the duplicate charges.

The following are not eligible for refund: change of mind or buyer's remorse, dissatisfaction with astrological interpretations or content, providing incorrect birth information that affects Product accuracy, not resonating with the astrological content, preference for different astrological systems or approaches, technical issues on your end such as device incompatibility, inability to download, or lost files, or failure to download within the one-year access period.

To request a refund under the exceptions described above, contact us at info@skylitpath.com within seven days of purchase. Include your order number and detailed description of the issue, and provide any relevant evidence such as screenshots or error messages. Allow us three to five business days to investigate and respond to your request.

If your refund request is approved, refunds will be processed to your original payment method. Processing time is typically five to ten business days. You will receive a confirmation email once the refund is processed. Depending on your bank or card issuer, it may take additional time for the refund to appear in your account.

If you initiate a chargeback or payment dispute with your bank or credit card company, we will provide evidence of Product delivery to your financial institution. Your account may be suspended or terminated, future purchases may be declined, and we reserve the right to pursue legal remedies for fraudulent chargebacks. We strongly encourage you to contact us first to resolve any issues before initiating a chargeback.

8. Intellectual Property Rights

All content on our Site and within our Products is owned by or licensed to Skylit Path Inc. and is protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to astrological interpretations and text, journal layouts and designs, graphics, images, and illustrations, website design and code, logos, brand names, and trademarks, algorithms and software used to generate Products, and educational content and astrology resources.

When you purchase a Product, we grant you a limited, non-exclusive, non-transferable, personal license to download and save your personalized Product for personal use, view and read your Product on your personal devices, print one physical copy of your Product for your personal use only, and reference your Product for personal reflection, journaling, and self-discovery.

You may not resell, redistribute, or share your Product with others whether for profit or for free, reproduce or copy your Product beyond the one personal print copy permitted above, modify, alter, or create derivative works based on our content or Products, publicly display or perform any portion of your Product or our content, upload or distribute your Product on file-sharing sites, social media, or public forums, use our content for commercial purposes without explicit written permission, remove or alter any copyright notices, watermarks, or proprietary markings, reverse engineer or attempt to recreate our algorithms or generation systems, extract or scrape data, text, or images from our Site or Products, or use our Products to provide astrological readings or services to others commercially or otherwise.

You may purchase a Product as a gift for another person by entering their birth information. Once delivered, the Product belongs to the gift recipient. You may not purchase one Product and share it with multiple people.

If you believe any content on our Site infringes your copyright, please contact us at info@skylitpath.com with a description of the copyrighted work you claim has been infringed, a description of where the infringing material is located on our Site, your contact information, a statement of good faith belief that the use is not authorized, a statement under penalty of perjury that the information is accurate, and your physical or electronic signature.

"Skylit Path" and our logo are trademarks of Skylit Path Inc. You may not use our trademarks without our prior written consent. Any reviews, testimonials, feedback, or other content you submit to us may be used by us for marketing, promotional, or other business purposes without compensation to you. By submitting content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such content.

9. Prohibited Uses

You agree that you will not use our Site or Products for any unlawful or prohibited purpose. You may not resell, redistribute, or commercially exploit our Products, use our Products to provide paid or unpaid astrological services to others, incorporate our content into your own commercial products or services, or purchase Products for the purpose of analyzing our algorithms or business methods.

You may not attempt to reverse engineer, decompile, or disassemble our software or algorithms, use any automated systems such as bots, scrapers, or crawlers to access our Site, attempt to gain unauthorized access to our systems, servers, or data, interfere with or disrupt our Site or servers, bypass any security features or access controls, or introduce viruses, malware, or other harmful code.

You may not provide false or misleading information during purchase or account creation, use another person's payment information without authorization, engage in credit card fraud or payment disputes in bad faith, or create multiple accounts to abuse promotions or circumvent restrictions.

You may not infringe upon our intellectual property rights or those of third parties, remove, alter, or obscure copyright notices or branding, claim our content as your own, or create derivative works without permission.

You may not use our Site or Products for any illegal purpose, violate any local, state, national, or international law, harass, abuse, threaten, or harm others, impersonate any person or entity, collect personal information about other users without consent, falsely claim affiliation with or endorsement by Skylit Path, misrepresent the source, origin, or ownership of our Products, or make false statements about our Products, services, or company.

If we determine in our sole discretion that you have engaged in prohibited activities, we may immediately terminate your access to our Site and services, cancel any pending or future orders, refuse to process refunds for prohibited use, pursue legal action and seek damages, report illegal activity to appropriate law enforcement authorities, and ban you from making future purchases. We reserve the right to investigate suspected violations of these Terms and to cooperate with law enforcement authorities.

10. User Submissions

We may allow you to submit reviews, ratings, testimonials, feedback, or other content about our Products or services. By submitting content to us, you agree that your submissions will be truthful and based on your actual experience with our Products, will not contain false, misleading, or deceptive information, will not violate any third-party rights including privacy, publicity, or intellectual property rights, will not contain offensive, defamatory, discriminatory, or inappropriate content, will not include personal information about others without their consent, and will not contain promotional content, spam, or commercial solicitations.

By submitting content, you grant Skylit Path a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display your submission in any media or format including our website, social media, marketing materials, and advertisements. We may use your name or username in connection with your submission unless you request anonymity. You retain ownership of your submissions, but you grant us the broad license described above and cannot revoke this license once granted.

We are under no obligation to post, display, or use any submission, to compensate you for any submission, to respond to or acknowledge receipt of submissions, or to maintain or return submissions to you.

We reserve the right to monitor, review, edit, or remove any submission, to refuse to post submissions that violate these Terms, to remove submissions at any time for any reason, and to disable or terminate accounts of users who violate our submission guidelines. The views expressed in user submissions are those of the individual users and do not represent the views of Skylit Path. We do not endorse or guarantee the accuracy of any user submissions.

You will not receive any compensation for your submissions. All submissions are provided voluntarily. By submitting content, you acknowledge that your submission may be made publicly visible. If you include personal information in your submission, it will be publicly accessible. Do not include sensitive personal information you wish to keep private.

You may not submit content that is illegal, threatening, abusive, harassing, defamatory, or invasive of privacy, infringes intellectual property rights, contains hate speech or discriminatory content based on race, religion, gender, disability, sexual orientation, or other protected characteristics, promotes violence or illegal activity, is sexually explicit or pornographic, impersonates another person or entity, contains viruses, malware, or other harmful code, or violates any applicable laws or regulations.

If you encounter user submissions that violate these guidelines, please report them to info@skylitpath.com. We do not verify the accuracy of user submissions. Your reliance on any user submission is at your own risk.

11. Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through our Site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through our Site, including the release of new tools and resources. Such new features and/or services shall also be subject to these Terms of Service.

12. Third-party Links

Certain content, products, and services available via our Site may include materials from third parties. Third-party links on our Site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

13. Disclaimers and Limitations of Liability 

Our Site and Products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Skylit Path Inc. disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that our Site will be uninterrupted, timely, secure, or error-free, that the results that may be obtained from the use of our Site or Products will be accurate or reliable, that the quality of any Products or services will meet your expectations, or that any errors in our Site or Products will be corrected. We do not warrant that our servers or the servers of third parties we use are free from viruses or other harmful components.

Astrological interpretations and content are provided for entertainment, educational, and self-reflection purposes only. Our Products are not intended to be a substitute for professional advice, whether medical, psychological, legal, financial, or otherwise. You should not rely solely on astrological information to make decisions about your health, relationships, career, finances, or any other important life matters. We strongly encourage you to consult qualified professionals for such matters.

The astrological interpretations provided in our Products represent one perspective among many approaches to astrology. Different astrological systems, techniques, and astrologers may produce different interpretations of the same birth chart. We do not guarantee that our interpretations will resonate with your personal experience or prove accurate in predicting future events. Astrology is not a science, and its effectiveness varies among individuals.

To the maximum extent permitted by applicable law, in no event shall Skylit Path Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, loss of use, loss of goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our Site or Products, any conduct or content of any third party on our Site, any content obtained from our Site, or unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort including negligence, or any other legal theory, whether or not we have been informed of the possibility of such damage.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you to Skylit Path for the Product giving rise to the claim, or one hundred dollars ($100), whichever is less.

Some jurisdictions do not allow the disclaimer of warranties or the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

You expressly agree that your use of, or inability to use, our Site and Products is at your sole risk. The Service and all Products are provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

14. Indemnification

You agree to indemnify, defend, and hold harmless Skylit Path Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, your violation of any law or the rights of a third party, your use or misuse of our Site or Products, any content you submit or transmit through our Site, your violation of any intellectual property or other right of any person or entity, or any harm caused to any third party through your use of our Site or Products.

This indemnification obligation will survive the termination of these Terms and your use of our Site and Products. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

15. PRIVACY

Your use of our Site and purchase of our Products are also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information, including your birth chart data.

Our Privacy Policy explains how we collect, store, use, and protect your personal information, including your name, email address, birth date, birth time, birth location, and billing information. It also describes your rights under applicable privacy laws, including the General Data Protection Regulation (GDPR) for European users and the California Consumer Privacy Act (CCPA) for California residents.

By using our Site and purchasing our Products, you consent to the collection and use of your information as described in our Privacy Policy. If you do not agree with our Privacy Policy, you should not use our Site or purchase our Products.

We take the security and privacy of your information seriously. All birth chart data and generated journals are encrypted using AES-256 encryption. Payment information is processed securely through Shopify Payments in compliance with PCI-DSS standards. For more information about how we protect your data, please refer to our Privacy Policy.

16. Changes to the Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to our Site or Products following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page. We may also notify you of significant changes via email if you have provided your email address to us, though we are not obligated to do so. Changes will be effective immediately upon posting unless otherwise specified.

If you do not agree to the modified Terms, you must stop using our Site and Products. Your continued use of our Site or Products after changes are posted means you accept and agree to the changes. 17. Termination

We may terminate or suspend your access to our Site and services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. Upon termination, your right to use our Site and access our services will immediately cease.

If we terminate your access for violation of these Terms, you will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our services or any part thereof. We reserve the right to refuse service to anyone for any reason at any time.

You may terminate your use of our Site at any time by ceasing to access our Site and Products. If you have created a Shop account, you may request deletion of your account by contacting us at info@skylitpath.com, though this does not entitle you to refunds for previously purchased Products.

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability. Termination of your access to our Site and services will not affect any rights or obligations that arose prior to termination.

18. GOVERNING LAW AND DISPUTES

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of our Site or Products shall be subject to the exclusive jurisdiction of the state and federal courts located in Arizona. You agree to submit to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Dispute Resolution Process:

Before filing any formal legal action, you agree to first contact us at info@skylitpath.com to attempt to resolve the dispute informally. Provide a detailed description of the dispute and your desired resolution. We will attempt to resolve the dispute informally by contacting you via email. If the dispute is not resolved within sixty (60) days of submission, either party may pursue formal legal remedies.

Limitation on Time to File Claims:

Any cause of action or claim you may have arising out of or relating to these Terms or our Site must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

Severability:

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Waiver:

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement:

These Terms of Service, together with our Privacy Policy and any other legal notices or policies published by us on our Site, constitute the entire agreement between you and Skylit Path Inc. concerning your use of our Site and Products. These Terms supersede any prior agreements, communications, and proposals, whether oral or written, between you and us.

Assignment:

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

Headings:

The headings used in these Terms of Service are included for convenience only and will not limit or otherwise affect these Terms.
