Meaning of "contumace" in the Italian dictionary

Inadmissibility, in law and especially criminal and civil procedural law, indicates the condition of those who - even though they have a duty to stand before a judge who examines a trial he or she does - omits to do so. Although the meaning of the most widespread meaning includes the intention of the person not to present himself, the inadequacy actually does not describe the degree of voluntariness of the non-appearance in the classroom, but merely establishes the non-constitution of the subject, being able to have also in default of notification and having verified a number of cases in which the defendant / defendant was not present because he was not aware of the opening of the proceedings at his expense, a situation which in fact disproves the regularity of the contradiction. La contumacia, nel diritto e specialmente nel diritto processuale penale e civile, indica la condizione di chi - pur avendo l'onere di costituirsi dinanzi al giudice che esamina un processo che lo riguardi - omette di farlo. Seppure il significato di più diffusa accezione vi includa l'intenzione dell'interessato di non presentarsi, la contumacia in realtà non descrive in sé il grado di volontarietà della mancata comparizione in aula, ma si limita a constatare la mancata costituzione del soggetto, potendosi avere contumacia anche in difetto di notifica ed essendosi verificati numerosi casi nei quali il convenuto/imputato non fosse presente perché non al corrente dell'apertura del procedimento a suo carico, situazione che vizia di fatto la regolarità del contraddittorio.
